Factions and Above Nether?

So, since it's possible to get to the world above the nether, does anyone know if you can use the Faction plugin to claim and protect land up there?

Factions, if I recall correctly, allows you to claim land based on chunks, doesn't it? If so, chunks go from Y=1 to Y=256, so you should ALREADY have claimed that area if you claimed the normal portion of the nether below.
