Per their Copyright notice at the bottom of this post, you cannot distribute Optifine Publically or Privately without express written consent. Just some constructive feedback to keep you out of trouble. Modpacks on Technic don't require permission; however if you plan to promote your pack elsewhere it would be required to get it, and it's better to have it anyway.
