On a legal stand point it is allowed. The reason the official packs don't have it is due to an imaginary copy right the mod author put on Optifine. The Technic team, not wanting to step on any more toes, just comply to these imaginary copy rights to stay in the good books of mod authors. They jump through the hoops of bull shit just to try and get us a good name. If you want it, it is very easy to install it yourself.

If you refereeing to a custom pack then you can put it in. Its not in any way illegal and the author can't do jack shit.

Your pack will likely be more popular with it and it being there in the list. People like it pre-installed :)
