Moderators Munaus Posted April 11, 2015 Moderators Posted April 11, 2015 (edited) did you create the mods in your pack? Edited April 11, 2015 by Munaus

Neowulf Posted April 12, 2015 Posted April 12, 2015 I see two packs using the voids wrath name. Totaling less than 10k runs combine with a year since their last updates. That's not a plague, and definitely not worth thousands of dollars in ad impressions.

Neowulf Posted April 12, 2015 Posted April 12, 2015 If it wasn't a concern, you wouldn't have brought it up. And while I can't be arsed to check, I assume your launcher serves banner ads and what's why you equate game runs with ad impressions? Not so with technic. Modpack specific ad impressions come from website views of the platform. And that's not even necessary. You can search and install packs directly from the launcher. Now, while I'm interesting to see what exactly you mean by "escalating" this issue, I'm feeling bored enough to just point you to the the "Report Modpack" button. Every modpack entry has it and I suggest you provide some actual relevant info in the report. Instead of this sad attempt at a professional business communication. If you really did some research into the laws I would expect more detailed info for your apparent claim of willful trademark infringement (you do have a registered trademark, correct?) and undue monetary enrichment. Instead you sound like an immature office employee "just saying" management bought the 3rd floor pizza but none for them.

Neowulf Posted April 12, 2015 Posted April 12, 2015 If you're going to imply you plan on taking the technic staff to court if they don't obey then you really do need to "talk in that manner". For all I know your "escalation" is a threat of stalking and physical violence. So best advice I can give right now is just stop with the "escalation" talk. It's painfully obvious you have no clue about the legal complexities (or even the basics) of the situation and are just using it as a way to scare prompt compliance out of the admins.
OfficialVoidsWrath Posted April 12, 2015 Author Posted April 12, 2015 (edited) Neowolf you are clearly trying to start an argument. I have asked to take this to PM. The escalation would be taken into legal matters you know very well what I was implying but we do not need to speak like that as we are trying to resolve this peacefully as should anyone before taking legal action. I suggest you just pass me onto your superior via pm as you are just making a fool of yourself at the moment starting an argument with someone who is not looking for a fight. I am simply trying to protect our brand and our programs best interests. If this issue was the other way around no question we would support your brands wishes and remove it. No one is scaring anyone I am informing you and any other staff member so that I could get directed to the correct person. Edited April 12, 2015 by OfficialVoidsWrath
Neowulf Posted April 12, 2015 Posted April 12, 2015 I honestly don't know who my superior is. No one here has played me in any FPS. Though if we're talking old school ones like tribes or quake2, I'm pretty sure I'm superior to all these muddafukkas. I'm a volunteer mod, not a secretary. If you wanted to contact the admins of this place you would have found the name yourself and contacted him via something other than a public forum post. So again. If you want to play the part of big boy businessman, then you have to actually be a big boy businessman. And that means doing your own research and figuring out just how weak your implied threats of legal action really are. Here's a hint: Your website betrays just how little you've done to legally protect yourself. Even amateur fanfiction blogs do a better job of ass-covering than the voidswrath website. And no, I'm not trying to start an argument. I tried to help with my first two replies, and switched to ridicule when you kept going with the big boy businessman facade.
OfficialVoidsWrath Posted April 12, 2015 Author Posted April 12, 2015 (edited) Every reply you have given me has been condescending and flat our rude. I was simply informing you of our claim to get you to realize this isn't a joke however your manners are as good as your grammar. You are a moderator you have an admin above you. I have tried several ways to contact technic so we are trying to contact the correct person through the forums however this is going no where and you clearly are a hot headed person who doesn't know a role of a moderator, so thanks for your time I will try contacting someone else. Melfice Posted April 12, 2015 Posted April 12, 2015 (edited) Mate. I had a look around. I can't find ANY trademarks connected to Voids Wrath, or any variation thereof. Now, unless the trademark is ambiguously named and/or under a personal name, you don't really have a claim where you could go to court (which I glimpsed may have been something you might be thinking of?). If you DO have a registered trademark, I'd love to see it. Or, at the least, would love it if you were to take that to the admin/owner of Technic. That's the only way you have solid footing, and a way of getting at least the pack art removed. But yes, like Neo said, your website doesn't even mention you have trademarks. That's... entrapment, maybe? Pretty sure it's not legal to hide the fact, and then take people to court over it. Edited April 12, 2015 by Melfice Noobsloth 1
Neowulf Posted April 12, 2015 Posted April 12, 2015 Oh yeah, there it is. I haven't had someone tell me I'm horrible at this because I didn't do as they demanded for weeks. I thought I was losing my touch... Aww melfice, you gave it away... But yeah. No copyright notice, no trademark notice, 100% sure they haven't looked at even wikipedia for the relevant laws and due diligence, let alone registered. And frankly <something>Craft is so completely overused for minecraft related projects I'm pretty sure Crazy Craft is ineligible for protections for being too generic. As for entrapment, no but there is a different problem. Specifically, if they don't display the trademark notice and don't take prompt action to protect their trademark then they lose that protection. It's why you always see the [TM] and (C) tags on everything, it's an arse covering measure. Also why fan projects get shut down all the time. The trademark owner MUST protect their trademark. So as cool as a project may be they NEED permission, and giving permission can weaken their stance if a commercial entity decides to get in on the action. It's just easier and cheaper for a corporation to be a dick than to deal with giving out permissions and risk losing protections if it gets too common.
Moderators Munaus Posted April 12, 2015 Moderators Posted April 12, 2015 nice move of editing your first posts out. I'm sure nobody will think that is shady as shit. I assume the answer you were gonna give me was: No, we did not create the mods we used for our pack.
